General Terms and Conditions of Sale
By placing an order, the customer declares that they have read and fully accept the following terms and conditions of sale, withdrawal, and payment.
1) Items for Sale:
All items for sale are marketed directly by Raks Distribution. The images and descriptions provided are constantly updated, but for bicycles and assembled products, the images and descriptions should be considered illustrative. Some details or individual components may differ, provided the quality of the components used remains equivalent.
2) Assembly:
All bicycles for sale are partially assembled to optimize transport. Some bicycles are 80% assembled, while others are fully assembled. Although assembling bicycles is within the capabilities of an average user, Bcycles.it always recommends seeking assistance from a technician or expert during assembly.
Not all bicycles come with an assembly manual. Bcycles.it is not responsible for the assembly of bicycles and will not be liable for any damage resulting from incorrect assembly of bicycles sold on the site.
3) Prices:
The sale prices indicated on the site are expressed in euros (€) and include VAT but do not include delivery costs. Delivery costs are always borne by the customer and are invoiced at the end of the order as a supplement to the selected products. The system automatically adds shipping costs. An invoice can be issued; in this case, please provide your VAT number for invoicing.
4) Product Characteristics:
The descriptions and characteristics of the products are provided directly by the manufacturers. Bcycles.it periodically updates product descriptions, which are not binding, as minor modifications to product characteristics by the manufacturer may occur at any time. Bcycles.it cannot be held responsible for non-substantial modifications by the manufacturer, such as differences in color tones of the saddle or other components, tire tread types, slight variations in component sizes, or replacement with equivalent minor components.
For electric-assist bicycles, the battery life provided is indicative and not binding. The specified battery life represents the maximum duration under ideal usage conditions (flat terrain, maximum weight of 70kg, and average assistance).
5) Availability:
All products marked as available on the site are usually shipped within 1-7 business days. Some products specify different availability times in their descriptions.
For items indicated as "Available on order," Raks Distribution acts as an intermediary, procuring them from third-party suppliers, potentially importing them, and shipping them to the requested address on behalf of the customer. The availability of such items is subject to confirmation after the order is placed. Raks Distribution is not responsible for any delays in the delivery of such items.
For "Available on order" items, a limitation of the right of withdrawal applies, as specified in point 8 of these conditions.
In the event the ordered product is unavailable or will become available beyond the specified time frame, Bcycles.it commits to contacting the customer via email or phone to inform them of the necessary delivery time or to cancel the order in case of unavailability.
Bcycles.it Raks Distribution emphasizes that the availability indicated on the site (if present) is indicative and does not constitute a contractual obligation or a basis for compensation or damage claims.
If an item ordered is found to be unavailable after the order is placed, Bcycles.it Raks Distribution will cancel the order and refund the amount paid directly to the customer via a refund or reversal of the payment method used for the order.
6) Delivery Methods:
Products purchased on the site can be delivered throughout Italy, including islands. The goods travel at the recipient's risk and will be delivered to the address indicated at the time of the order.
The delivery times indicated are approximate and subject to changes. Customers are also reminded that couriers transport and deliver products only on business days, from Monday to Friday.
Bcycles.it cannot be held responsible for delays in delivery or damage to goods during transportation by the courier. However, Bcycles.it may replace damaged parts if the package is marked as "accepted with reservation" upon delivery. Minor scratches or abrasions up to 20mm caused during transportation are not considered damages.
7) Delivery Costs:
Shipping costs vary depending on the type of item purchased. For orders over €149 and for bicycles, delivery is free throughout Italy via express courier. For cash-on-delivery payments, a fee applies even for free shipping and is calculated based on the order amount, as shown in the shopping cart.
8) Right of Withdrawal:
a) Internet sales are governed by Legislative Decree 206/05, which regulates distance contracts, i.e., those conducted outside commercial premises.
This regulation establishes the right of withdrawal, allowing consumers to return purchased products and obtain a refund for the expenses incurred.
This right applies exclusively to individuals (consumers) and cannot be exercised by legal entities or individuals acting for purposes related to their professional activity. To exercise the right of withdrawal, customers must return the items they wish to return within 14 days of receipt. Return shipping costs are entirely the customer's responsibility, and the customer bears the risk of transportation and any damage to the goods.
b) The right of withdrawal does not apply to customized products, including "special garage" bicycles created to customer specifications, custom-built components (e.g., wheels), and electric bicycle batteries.
c) For certain items that are hard to source or specifically imported upon request and marked as "available on order," a withdrawal for reconsideration is permitted. However, 20% of the product cost will be withheld to cover expenses and damages incurred for placing the order on behalf of the customer.
d) The right of withdrawal is entirely void if the returned product is not intact, such as:
- Missing original packaging (for bicycles).
- Missing integral elements of the product (accessories, disassembled parts, etc.).
- Product damage or wear.
e) Bcycles.it will process the refund order for the cost of the returned goods within 14 working days of receiving the returned merchandise, but not before receiving the goods. Refunds will be issued only via bank transfer, non-transferable check, or the original payment method.
f) For returns or refunds not due to Bcycles.it's fault, the refund will be issued net of the original shipping costs.
g) The right of withdrawal does not apply to purchases made through financing or leasing.
9) Return of Used Goods:
By completing the purchase and accepting these terms, the customer consents to the following: if used items subject to wear are returned within the 14-day withdrawal period, a refurbishment fee will be applied. This fee is set at 25% of the purchase value for complete muscle bicycles and e-bikes.
10) Warranty and Certification:
The products sold on our site, where explicitly indicated and if required by law, are certified with CE or EN approval. All products are covered by the manufacturer's conformity warranty for a period of 2 (two) years from the delivery date in case of manufacturing defects.
For batteries and electrical parts of e-bikes, the warranty duration is 12 months unless otherwise stated in the product description. The extended warranty applies only to end users. Damage caused by incorrect assembly by the customer and/or normal wear and tear of components is excluded from the warranty.
Note: For fixing the cog to the hub in fixed mode for Flip/Flop wheels, expert intervention with a proper tightening tool is required. If the cog is not properly secured or periodically checked, the hub may strip. Stripping of hubs in track mode is excluded from the warranty for this reason.
For individual bicycle components, where national and local distributors are present (e.g., Shimano, Miche, or SRAM components), please refer to the local distributor.
11) Personal Data Processing and Privacy:
BCYCLES.it guarantees the utmost confidentiality of the information and data you provide during registration. When placing an order, we require your name, email address, delivery address, and payment details. This information allows us to process and fulfill your order and keep you informed about its status.
Information about your purchases helps us personalize the website and suggest products that might interest you. We use this data to develop our offerings, inform you of potential winnings, and monitor customer satisfaction with our marketing activities.
We may also use your data to contact you with news, personalized special offers, and various promotions. Please note that you can exercise your rights under Legislative Decree 196/2003 at any time and free of charge, including consulting, modifying, or deleting your data, or objecting to its use for marketing and commercial communication purposes via the contact form.
